Terms of Service
Effective 23 October 2026. Early access version.
The short version
- PhotoSeam is free while it is in early access. It is new, it will change, and things may break.
- Your photos and your clients' data stay yours. You give us only the permission needed to run the service for you.
- You are responsible for having the right to upload and share your photos and your clients' details.
- Keep your own copies. PhotoSeam is not a backup.
- If early access ends, we tell you at least 30 days ahead and help you get your data out.
1. Who this agreement is with
These terms are an agreement between you and PhotoSeam ("PhotoSeam", "we"). By creating an account you accept them and our Privacy Policy. If you do not agree, please do not use PhotoSeam.
2. Early access
- PhotoSeam is offered free of charge to a small group of photographers while we build it.
- Features will be added, changed or removed, sometimes quickly. We may set limits, for example on storage space, and will tell you before a limit affects you.
- We will never charge you without telling you first and getting your agreement. If paid plans come, you can choose not to continue.
- We value your feedback. If you send us ideas or suggestions, we may use them freely without owing you anything.
3. Your account
- You must be at least 18 and use PhotoSeam for your photography work.
- Give a real email address and keep your password private. You are responsible for what happens in your account.
- One account is for one photographer or studio. Tell us at privacy@photoseam.com straight away if you think someone else got into your account.
4. Your content stays yours
You own your photos, your client list, your contracts and everything else you put into PhotoSeam ("your content"). We claim no rights over it.
So that PhotoSeam can work, you give us a limited permission to store, copy, process and display your content, only to provide the service to you: for example to keep your files, make previews and thumbnails, add your watermark, show galleries to the people you share them with, and send the emails you ask for. This permission is worldwide because our providers' servers are, it does not let us use your content for anything else (no marketing, no training of AI, no selling), and it ends when your content is deleted, apart from backup copies that expire as described in the Privacy Policy.
5. Your responsibilities
- Rights to your photos. You must own or have permission to use every photo you upload, and permission from the people in them where the law requires it (image rights, model releases).
- Your clients' data. You are the controller of your clients' personal data. You must have a legal basis to put it into PhotoSeam and to share galleries with them, tell them you use PhotoSeam (you can point them to our Privacy Policy), and handle their requests to see, correct or delete their data.
- Children. For photos of children, you must have the permission of a parent or guardian.
- Sharing. Gallery links and PINs work like keys. Send them only to the people meant to see the gallery.
- Keep your own copies. Always keep your original photos and important records somewhere else too. PhotoSeam is a workflow tool, not a backup service.
- Sensitive details. Do not put sensitive personal data (health, religion, identity document numbers) into notes unless you really need it for the job.
6. Acceptable use
Do not use PhotoSeam to:
- upload anything illegal, including sexual content involving minors, content that violates someone's privacy or image rights, or content you have no right to share;
- harass, threaten or deceive anyone, or send spam through gallery or booking emails;
- break, overload, probe or get around the security of the service, or access other people's data;
- copy, resell or rebuild PhotoSeam, or use automated tools to pull data out of it beyond your own account;
- store files that are not part of your photography work, or use it as general file hosting.
We may remove content or suspend an account that breaks these rules. We will tell you why, and give you a chance to fix it first unless the problem is serious or urgent.
7. How we handle your clients' data for you
For your clients' personal data, you are the controller and we are your processor. We agree to:
- process it only to provide PhotoSeam as you use it, following your instructions through the app and these terms;
- keep it confidential, and allow access only to people who need it to run the service and are bound to confidentiality;
- protect it with the security measures described in the Privacy Policy;
- use only the providers listed in the Privacy Policy, and tell you before adding or replacing one, so you can object or leave;
- help you answer your clients' requests and meet your own legal duties, as far as we reasonably can;
- tell you without undue delay if a security incident affects your clients' data;
- delete it when you delete it in the app or close your account, apart from backups that expire on their own;
- give you the information you reasonably need to show you comply with data protection law.
8. The service, as it is
We work with reasonable care and skill to keep PhotoSeam running, secure and accurate. But it is an early, free product: it is provided "as is" and "as available", without promises that it will always be online, error-free, or fit for a particular purpose. Plan for the possibility that it is unavailable for a while, or that something is lost.
9. Changes, ending, and getting your data out
- You can stop at any time. To delete your account and all its content, email privacy@photoseam.com from your account address.
- We may change or end early access. If we end it or stop offering PhotoSeam, we will email you at least 30 days before, and keep your data available during that time so you can take it out.
- What you can take out yourself today: each gallery's list of chosen photos as a Lightroom file list or a CSV (with names, emails and notes), each calendar session as an .ics file, and your whole schedule through the calendar feed. In finals galleries with downloads turned on, photos can be downloaded one at a time or all at once.
- What you cannot take out yourself yet: there is no one-click export of everything. Until there is, email us and we will send you a copy of your data (as spreadsheet files) and your photo and contract files.
- Suspension. We may suspend or close an account that seriously or repeatedly breaks these terms, with notice when possible.
10. Limits on our liability
In plain terms:
- We are not responsible for indirect losses, such as lost profits, lost bookings or lost business opportunities, caused by using or not being able to use PhotoSeam.
- We are not responsible for losing content you did not keep a copy of, unless the loss is caused by our gross negligence or deliberate act.
- While PhotoSeam is free, our total liability to you for any claim is limited to USD 100.
- Nothing in these terms limits liability that the law does not allow to be limited, such as for gross negligence or wilful misconduct, or takes away rights you have under consumer law that protects you.
If someone makes a claim against us because of content you uploaded without the right to do so, or because you broke these terms, you are responsible for that claim.
11. Changes to these terms
If we change these terms in a way that matters, we will email you at least 30 days before the change takes effect. If you do not agree, you can stop using PhotoSeam and ask us to delete your account. If you keep using it after that date, the new terms apply.
12. Law and disputes
These terms are governed by the law of the country PhotoSeam is run from. Before going to court, please write to us so we can try to sort it out. If you are a consumer, you keep any right your local law gives you to bring a claim where you live.
